Ordinances
*Below is a brief summary of some of the Village ordinances. A complete copy is available for review at the Village Office.
- Domestic Animals
Residents may have up to 3 per household.
- 6-101 - Licensing of Dogs
Dogs over the age of 6 months within the Municipality shall within thirty days after acquisition must acquire a license fro each dog annually by the April 1st of each year. Cost of license is $5.00 and a certificate that the dog has had a rabies shot, effective for the ensuing year of the license shall be presented when the license is applied for. No license shall be issued until the certificate is shown.
- 6-106 – Un-collared Dogs
All dogs found running at large upon the streets and public grounds of the Municipality without a collar or harness are hereby declared a public nuisance and shall be impounded in a place designated by the Governing Body.
- 6-107 - Dogs Running at Large
It shall be unlawful for the owner of any dog to allow such dog to run at large at anytime within the corporate limits of the Municipality. It shall be the duty of any person so designated by the Governing Body to cause any dog found to be running at large within the Municipality to be taken up and impounded. “Running at Large” shall mean any dog found off the premise of the owner, and not under control of the owner or responsible person, either by leash or other suitable means of physical restraint.
- 6-201 – Animals; Banned from Municipality
It shall be unlawful for any person to keep or maintain within the corporate limits any horse, mule, sheep, cow, goat, swine, or other livestock
- 6-303 Nuisances, Weeds, Grasses and Litter
A nuisance is hereby declared to be and defined as permitting, allowing, or maintaining any growth of twelve (12) inches or more in height of weeds, grasses, or worthless vegetation, or to cause litter to be deposited or remain on any premises together with one half of the streets and alleys abutting thereon, in the municipality except in proper receptacles. Litter shall include but not be limited to trash rubbish garbage, wood, mason material, any machines, vehicles, or parts thereof, wreckage or junk. Any owner or occupant not in compliance with this ordinance shall upon conviction of violating such ordinance, be guilty of a Class V misdemeanor.
- 6-306 Discharge of Firearms
It shall be unlawful for any person, except an officer of the law, to fire or discharge any gun, pistol, etc within the Municipality.
- 6-307 Discharge of Slingshots, Air Guns, and BB Guns
It shall be unlawful for any person to discharge a slingshot, air gun, or the like loaded with rock or other dangerous missiles at anytime or under any circumstances within the Municipality.
- 6-312 Curfew
It shall be unlawful for any minor under the age of eighteen to ride in or operate any vehicle in or upon any public way or to loiter, wander, stroll, loaf, or play in or upon any public way between the hours of 10:00p.m. Sunday thru Thursday, until 12:00p.m. Friday and Saturday and until the hour of 6:00a.m. unless accompanied by a parent or guardian or is engaged in lawful employment or is on an emergency errand; provided, when an activity of the kind normally attended by minors under 18 terminate the curfew shall commence 1 hour after the termination of such activity.
- 6-313 – Abandoned Automobiles
It shall be unlawful to abandon any automobile, on the Municipal streets, highways, alleys, parks or other property. An automobile shall be deemed to be abandoned if left unattended: A: With no number plates affixed thereto, for more the 6 hours on any public property or, B: For more than 24 hours on any public property, except where parking is legally permitted; or, C: For more than 48 hours, after parking of such vehicle shall have become illegal, if left on a portion of a public property on which parking is legally permitted; or D: For more than 7 days on private property if left initially without permission of the owner or after permission of the owner shall be terminated.
- 8-108 – Overhanging Branches
The owner or occupant of any lot, piece, or parcel of ground abutting or adjacent to any street or sidewalk over which there extends the branches of trees shall at all times keep the branches or limbs thereof trimmed to the height of at least 8 feet above the surface.
- 8-201 – Sidewalks; Kept Clean
It shall be unlawful for any occupant of any lot or the owner of any vacant lot within the corporate limits to allow snow, sleet, mud, ice or other substance to accumulate on the sidewalks or to permit any snow, sleet, ice, mud or other substance to remain upon said sidewalk within 12 hours after the cessation of any snow storm. It shall be unlawful to place snow and ice on any alley or street right-of-way from private sidewalks, driveways or other private property.
- – Snow Emergency
When a snow emergency is declared it shall be unlawful for any person to park any vehicle of any kind on any street, highway, avenue, boulevard or other public way within the Village of Herman. Please listen to local TV or radio stations for such information.
- 9-201 – Building Permits
It shall be unlawful for any person, firm or corporation to commence or to proceed with the erection, construction, reconstruction, conversion, alteration, enlargement of, extension of any building, or any part of said building, when the cost of said work is over $500.00 without first having applied for a building permit. Application for a building permit shall be in writing and be delivered to the Village Clerk. Such application shall be accompanied by plans and specifications showing the size of the proposed building or structure and it’s location on the lot, and in all cases the proposed construction material and type of construction to be used and any pertinent details including the estimated cost. Application forms and information packets are available at the Village Office.
*Please note: Building permits are also required for fences and swimming pools.
- 11-514 – Swimming Pooling
A swimming pool may be permitted in any district as an accessory use subject to the following requirements:
A. Pool can not be located in any front or side yard abutting a street
B. Every swimming pool must be completely surrounded by a fence or wall not less than 48” in height with no openings large enough to permit children to pass through other than gates or doors that can be fastened to protect against entry. A building may be used as part of such required enclosure.
C. All gates or doors must be equipped with a self-closing and self-latching device.
- 11-517 – Storage and Parking of Mobile Homes Trailers & Commercial Vehicles
Commercial vehicles and trailers of all types, including camping units, travel & hauling trailers and mobile homes, shall not be parked or stored on any lot occupied by a dwelling or on any lot in any Residential District, except in accordance with the following provisions:
A. Not more than 1 commercial vehicle, not to exceed 1 ½ tons.
B. Not more than 1 camping unit, travel or hauling trailer. Said unit shall not be parked/stored for more than 1 week unless it is located behind the front yard building lines.
